Has anyone had any experiences working as a Recovery Specialist at a collection agency? Is this a bad job?

I have been on the other side. (Business only) You need to be a bulldog with no sympathy at all. Ruthless and consistent. Can make some money if you are real good and obnoxious.

There’s a collection agency that keeps calling me about a debt that I do not owe. They still don’t stop calling even though I keep telling them it’s not mine. What legal actions can I take against them?

This usually works very well:

Step One:

Send them a letter via Certified Mail + Return Receipt stating:

Per the Fair Debt Collection Practices Act, I am requesting that you cease all communications with me about this alleged debt. This debt does not belong to me. This letter is being time stamped via Certified Mail and I can confirm receipt. I will pursue each subsequent phone call from your office with a $1,000 per incident penalty for Fair Debt Collection Practices Act violations.

Step Two:

Next time they call, read the following statement:

Pursuant to [your state] state law, this is to inform you that this phone call is being recorded. If you do not consent to being recorded, you need to terminate this call. Pursuant to [your state] state law, continuation of this phone call after officially being informed that it is being recorded implies consent to be recorded. This recording will be used to pursue Fair Debt Collection Practice Act violations in a court of law.

How to settle with a collection agency?

I owe capital one 4,000
I want to pay by making payments to the collection agency but they said "no"
If I want to settle with them what are the proper steps to take?

"Charged off" doesn’t mean that you don’t owe the money. Rather it’s a bank term meaning they don’t consider the debt current, drawing interest, so they can count it as a valid asset on their books with the regulators.

Collection Agencies are only interested in collecting money. They don’t accept payment plans with minimal payments as if you still had a credit card with Cap One. However, they will work out installments with you, if they meet their parameters. Try sending in some money to them. I guarantee they will NOT send it back. Usually if something is paid on the account monthly on a regular basis, at least they won’t sue you unless the statute of limitations is coming close. If you want to truly settle with them; then they are going to want to know your current financial circumstances in order to make a decision as to what they think you can pay or what they think they can collect from you. Better to settle than for them to get a judgement and garnish your wages; take other assets, if you have them.

How can I sue a collection agency located in IL and I am located in NY?

This collection agency has attorneys working for them in NY state. I have been to court 2 times already and filed an order to show cause. My motion was denied to get it vacated. They still have not yet validated this alleged debt they claim I owe. I have no charge cards at all. They are now garnishing my check. What should I do now?

What to do with a credit collection agency summon?

I decided to go on ahead and fight back on my summon. Now the collection agency is calling me everyday day and night non-stop. I have a debt settlement agency and said they will be the one in contact with my creditors. I decided to go on debt settlement. So please I need your professional advises on this. Thanks a lot. I just want to get rid of all my credit cards.

Answer the phone and give them the debt settlement agency’s number. DO NOT give them any other information as they will try.

Advise them not to call your house again. As for calling all day they program those computers to do that. You have to either just not answer the phone or check caller id first. Or take the phone off the hook. This is a ploy that works for them. If they call you day and night many people will eventually send them their last penny so they will go away. don’t fall for it.

A collection agency has gotten my number by mistake, and they keep calling me waking me up in the morning, looking for a guy who I don’t know. They promise me every day that they’ll take my number off of their list, but they never do. Is there any way I can stop this? I need my sleep! Thanks.

Send them the following letter certified mail/return receipt. You just fill in the information.

SUBJECT: Cease contact on debt regarding ___________________________ (Name of person the debt collection agency is contacting you about)

To whom it may concern:

Under the Fair Debt Collections Practices Act, I am exercising my right to request that you cease all contact with me about debt owed to you by [name of person the collection agency is calling you about].

That person does not live at this address and cannot be reached at this phone number. If your company can prove that this debt is mine or that this person is in some way connected to this address and phone number, please send proof of that claim to me in writing, again in accordance with the provisions under the Fair Debt Collections Practices Act.

Please also confirm to me in writing that you acknowledge this request and that your company will honor this cease action notification. If not, I will be forced to seek legal action and file a complaint with the Federal Trade Commission Bureau of Consumer Protection. It is also my understanding that your company has two weeks to respond to this letter.

How long can a collection agency sit on a debt before they start to collect?

I HAVE A COLLECTION AGENCY THAT HAS HAD A DEBT OF MINE SINCE 2002 AND JUST NOW REPORTED ME AND TRYING TO COLLECT. THE ORIGINAL CREDITOR NEVER CONTACTED US TO COLLECT ON THE DEBT EITHER. SO THIS HAS BEEN SITTING OUT THERE SINCE 2001. ITS A HOSPITAL BILL

I actually work for a medical collection agency. In most cases, the agency will first send you a series of letters letting you know your rights. They will then try to contact you by phone, usually 5-8 attempts. There must be some reason they have been sitting on this so long. Were they trying to deal with your insurance? They also might have been doing a legal check on you to see if they should pursue the account legally. They really haven’t done anything wrong and the original provider doesn’t have to bill you. Also, was there a problem with your address? Anyway, in most states the statute of limitations(SOL) is 6 years on a medical debt. If they don’t sue you, then you’re fine. If they did report it to the credit bureau then it will only be on there for another two years. (7 years from the date of service)
